MedPal Provider Disclaimer

This disclaimer applies to Healthcare Providers and Patient Advocates ("Providers," "you") using the MedPal Provider mobile application and onboarding web application (together, the "Provider Apps") to connect with patients ("Customers") through MedPal, LLC’s platform ("MedPal," "we," or "us"). This disclaimer is in addition to, and does not replace, the Healthcare Provider Terms of Use, Privacy Policy, and Acceptable Use Policy, which govern your full use of MedPal’s services.

By using the Provider Apps, you acknowledge and agree:

1. No employment or agency relationship. MedPal does not employ, contract, or supervise you. The Provider Apps facilitate connections between you and Customers. Any healthcare services you provide are a direct relationship between you and the Customer, to which MedPal is not a party.

2. Your license and scope of practice. You are solely responsible for holding all applicable licenses, registrations, telehealth permits, and authorizations required by the state in which you and the Customer are located, and for practicing within your scope under applicable law. Patient Advocates may not provide diagnosis, treatment, prescribing, or other licensed healthcare services through the Provider Apps.

3. No medical advice from MedPal. Content available through the Provider Apps is informational only. Nothing on or available through the Provider Apps constitutes medical, mental health, dental, or any other professional advice from MedPal.

4. Emergencies. If a Customer indicates a medical emergency, you should advise them to call 9-1-1 or seek emergency care immediately. The Provider Apps are not designed for emergency or urgent care.

5. Customer information. Information shared by Customers through the Provider Apps may be incomplete, inaccurate, or out of date. You are responsible for independently verifying any information relevant to the services you provide, including identity, history, contraindications, and consent.

6. Privacy and data handling. MedPal collects, uses, and discloses information about you and your interactions with the Provider Apps as described in our Privacy Policy. Please review the Privacy Policy carefully before using the Provider Apps.

7. Compliance with law. You are responsible for complying with all federal and state laws applicable to your practice, including telehealth statutes, controlled substance laws (including the Ryan Haight Act), informed consent requirements, and applicable privacy and security laws.

8. No warranty of accuracy or availability. The Provider Apps are provided "as is" and "as available," without warranties of any kind. MedPal is not responsible for any decision you make or action you take in reliance on the Provider Apps, including any technology issue, service outage, or third-party content or link.

9. Use at your own risk. Your use of the Provider Apps is at your own risk. To the maximum extent permitted by applicable law, MedPal disclaims all liability arising from your use of the Provider Apps, subject to the limitations in the Healthcare Provider Terms of Use.

By continuing to use the Provider Apps, you confirm that you have read, understood, and agree to this disclaimer, together with the Healthcare Provider Terms of Use, Privacy Policy, and Acceptable Use Policy. If you do not agree, do not use the Provider Apps.
